Living Trust

A living trust an estate planning vehicle that gives you control over who gets your assets when you pass away. A significant benefit of a living trust is that it can help your beneficiaries avoid the expense of probate.

Creating a living trust is a two-step process: 1) your living trust is created, and 2) then funded, your assets are transferred to the trust. You'll be named as the Trustee, and will manage the trust until your death. Your assets are then passed to your designated beneficiaries. In an event that you become incapacitated or no longer able to manage your trust assets, the successor trustee named in your trust can then take over the management of the trust assets. 

 

A Living Trust Document is required to be signed by the parties in the presence of a notary public and notarized to become effective.

Will

A Will is a legal document that indicates your desire for the distribution of your assets and property following your death. With this estate planning vehicle, you'll have decision-making control over who will be responsible to administer your estate and follow your wishes (the executor or personal representative), who gets what (the beneficiaries) and also, how and when they are to receive it.

 

The Will is most suitable for clients with smaller estates and for those with minor children.  A Will allows you to state whom you want to be responsible for the care of your child(ren) (by electing a guardian) in an event that something happens to you. Without a Will, these decisions will be made by the court, not you.

Nonprofit Incorporation

Incorporation is the legal process for the creation of a new nonprofit corporation, which is an organization that is approved by the State of California to conduct business. A corporation enjoys rights and obligations much like a real person and can own property as well as enter into agreements. Corporations provide legal protection for personal assets because the owners of a corporation are, in most cases, not personally responsible for the corporation's debts and/or liability.

Durable Power of Attorney

Durable Power of Attorney allows you to delegate broad authority over your personal financial affairs. This type of planning may be very important to have if you become incapacitated (temporarily or permanently) or unable to manage your financial affairs. Having a durable power of attorney stops the court from having to appoint someone to take control of your finances and make decisions for you. A durable power of attorney goes into effect the moment you are not able to make decisions for yourself until your death.

Healthcare Directive

Advanced Health Care Directive allows you to appoint someone you trust to make health care decisions on your behalf, at a time when you lose the ability to make decisions for yourself. By appointing a health care agent, you can make sure that health care providers carry out all your wishes. Your agent can also decide how your wishes will be carried out if your medical condition changes. Hospitals, doctors, and other health care providers must follow your agent's decisions as if they were your own. This document gives the person you select as your health care agent as little or as much authority as you want. You may allow your agent to make all health care decisions or only certain ones. You may also give your agent instructions that he or she has to follow. This form can also be used to document your wishes or instructions with regard to organ and/or tissue donation.
